Gift Card Terms & Conditions
These Gift Card Terms & Conditions (“Gift Card Terms”) apply to all gift cards, gift certificates, and digital gift codes purchased, sent, received, or redeemed through GiftIt LLC’s services (the “Services”). They supplement, and are incorporated into, the GiftIt Terms of Service.
1. Federal protections — Credit CARD Act of 2009
Gift cards sold through the Services that are subject to the federal Credit CARD Act of 2009 and Regulation E (12 CFR §1005.20):
- will not expire earlier than five (5) years from the date the gift card is issued or, if later, from the date funds are last loaded onto the card;
- are not subject to dormancy, inactivity, or service fees unless there has been no activity for at least twelve (12) consecutive months, and then no more than one such fee may be charged in any single month; and
- display required disclosures regarding expiration dates and any fees, including a toll-free number or website where you can obtain fee information.
Some gift cards — such as loyalty, award, or promotional cards — are exempt from one or more of these federal protections. Where a gift card is exempt, that will be disclosed before purchase.
2. State law protections
Many U.S. states extend protections beyond federal law. The following summary is provided for convenience only and is not legal advice. The protection that applies to your gift card is determined by the state of issuance, the state where you redeem the card, the issuing brand’s own state of operation, and the specific facts. Refer to your state attorney general or consumer-protection authority for definitive guidance.
California
Gift certificates and gift cards sold in California generally do not expire and may not carry service fees, with limited exceptions. Effective April 1, 2026, California requires retailers to redeem any gift card with a remaining balance under $15 for cash, raised from the prior $10 threshold.
Massachusetts
Massachusetts gift cards are valid for at least seven (7) years from the date of issuance and may be redeemed for cash when ninety percent (90%) or more of the original value has been redeemed.
New York
New York imposes a five-year dormancy period after which unredeemed gift card balances may be reported to the state as unclaimed property; certain monthly maintenance fees are restricted and may only begin after 25 months of inactivity.
Other states
Additional cash-redemption thresholds and expiration limits apply in Colorado, Connecticut, Maine, Minnesota, Montana, New Jersey, New Mexico, Oregon, Rhode Island, Vermont, Washington, and other states. Several states (including Maryland and New Jersey) have recently adopted gift-card fraud-prevention requirements that may apply to retailers and resellers.
3. Unclaimed property and escheatment
Unredeemed gift card balances may, in certain states, become subject to that state’s unclaimed-property (escheatment) law after a statutory dormancy period. GiftIt and its gift-card supplier(s) report and remit unclaimed balances where required by law. If a gift card balance is reported as unclaimed property, you may be able to recover it by filing a claim with the relevant state.
4. Redemption
Each gift card may be redeemed only at the merchant identified on the card, subject to that merchant’s own redemption rules (including any in-store, online, or app-only restrictions). Codes, PINs, and links are unique and are intended for the recipient identified at purchase. You must keep the redemption code confidential; GiftIt and the issuing brand are not responsible for unauthorized redemption arising from disclosure or loss of the code.
5. No cash refunds for purchased gift cards
Except where required by applicable state law (including state cash-redemption thresholds for small remaining balances) or where a brand requires otherwise, gift cards purchased through the Services are non-refundable, non-returnable, and not redeemable for cash. See our Refund Policy for the limited circumstances in which we may refund a purchase.
6. Lost, stolen, or compromised gift cards
Treat redemption codes like cash. If you believe your code has been lost, stolen, or used without authorization, contact us immediately at support@trygiftit.comand, where applicable, contact the issuing brand. We will work with our supplier(s) to investigate and, at the brand’s discretion, may attempt to replace or refund an unredeemed code. Replacement is not guaranteed and depends on the brand’s policy and applicable law.
7. Risk of fraud
Gift cards are a common target for scams. GiftIt and legitimate brands will never ask you to use a gift card to pay a bill, fine, tax, bail, or other debt, or to verify your identity over the phone. If anyone instructs you to buy a gift card to pay them, it is almost certainly a scam — stop and contact local consumer-protection authorities and us at support@trygiftit.com.
8. Bulk and business purchases
Gift cards purchased through GiftIt Business are subject to these Gift Card Terms and to the Business Customer Agreement. Bulk orders may be subject to additional verification, fraud-prevention review, and brand-imposed volume restrictions.
9. Resale prohibited
You may not resell, exchange, or auction gift cards purchased through the Services without GiftIt’s prior written consent. We may void and refund any gift card we reasonably believe was purchased with the intent to resell or that was acquired through fraudulent means.
10. Changes
We may update these Gift Card Terms from time to time. Material changes will be communicated as described in our Terms of Service. The version in effect at the time of your purchase governs that purchase.
