Acceptable Use Policy
This Acceptable Use Policy (“AUP”) describes prohibited conduct and content on the GiftIt services (the “Services”). It applies to every user, account, recipient, business administrator, and Authorized User. Violation of this AUP is a material breach of the Terms of Service and the Business Customer Agreement and may result in suspension or termination of access, forfeiture of unredeemed credits, and referral to law enforcement.
1. Lawful use
You may not use the Services in any way that violates applicable law, regulation, or third-party right, including (without limitation) laws governing payments, money transmission, anti-money laundering, sanctions and export controls, consumer protection, tax, anti-spam, employment, anti-bribery, and intellectual property.
2. Prohibited transactions
You may not use the Services to:
- purchase, resell, exchange, or auction gift cards in violation of the Gift Card Terms or any brand’s terms;
- fund or facilitate fraud, including any scheme that pressures another person to buy or send a gift card to pay a debt, fine, tax, or impersonator;
- launder money, evade sanctions, or finance terrorism;
- conduct transactions on behalf of any person or entity sanctioned by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) or any equivalent authority;
- engage in chargeback abuse, including initiating chargebacks for gift cards that were successfully delivered and redeemed;
- misrepresent the source, recipient, or purpose of a purchase to bypass fraud controls; or
- process bulk or automated purchases for resale without our prior written consent.
3. Prohibited conduct
- Do not impersonate another person, create an account using false information, or operate multiple accounts to evade limits, suspensions, or fees.
- Do not harass, threaten, stalk, defame, or send abusive content to other users, recipients, or our team — including in the personal-message field on a gift card.
- Do not send content that is unlawful, sexually explicit involving minors, hateful, violent, or that infringes any third-party right.
- Do not collect, harvest, or scrape personal information, gift-card codes, or product data from the Services.
- Do not send unsolicited bulk messages, spam, or marketing through the Services in violation of CAN-SPAM, TCPA, or similar law.
4. Security
- Do not attempt to access any system, account, or data you are not authorized to access.
- Do not probe, scan, or test the vulnerability of the Services, or breach or circumvent any security or authentication measure, except as expressly authorized by GiftIt under a written security-research arrangement.
- Do not introduce malware, viruses, worms, or any other harmful code.
- Do not interfere with or disrupt the Services, our infrastructure, or any user’s use of the Services, including by overloading endpoints, conducting denial-of-service attacks, or generating excessive automated traffic.
- Do not reverse engineer, decompile, or disassemble any part of the Services, except where such restriction is expressly prohibited by applicable law.
5. APIs and automation
Access to GiftIt APIs requires the credentials we issue and is subject to the rate limits, scopes, and documented usage rules we publish. Do not share API credentials, exceed the documented rate limits, or use APIs to build a competing service. We may revoke API access at any time for violation of this AUP or for activity that we reasonably believe risks the stability or integrity of the Services.
6. Content you upload
You are responsible for the legality, accuracy, and appropriateness of any content you upload — including business logos, recipient lists, personal messages, campaign artwork, and uploaded verification documents. You represent that you have all rights necessary to upload that content and to grant the license described in our Terms.
7. Reporting violations
If you believe someone is violating this AUP — including suspected fraud, scams, or unauthorized access — report it to support@trygiftit.com. For confirmed intellectual-property infringement, follow the procedure in our Terms of Service. For security vulnerabilities, contact legal@trygiftit.com.
8. Enforcement
We may investigate suspected violations, cooperate with law enforcement, and take any action we deem appropriate, including (a) removing or refusing to deliver offending content; (b) limiting or terminating access; (c) voiding undelivered or unredeemed gift cards purchased in violation of this AUP; (d) reporting illegal activity to authorities; and (e) pursuing legal remedies.
9. Changes
We may update this AUP from time to time. Updates take effect when posted. Continued use of the Services after a change constitutes acceptance.
